Terms and Conditions of Sale
1. Your purchase of goods from Exotic Planet is subject to these Terms and Conditions of Sale (Terms), the Terms of Use and any Catalogue Terms. If you do not accept these Terms, you must refrain from using this website or making a purchase from this website. Please read the following carefully.
2. The Exotic Planet words and logo are never to be used, transferred or reproduced by any persons or entity in any manner without the express written permission of an authorised agent of Exotic Planet.
User Agreement
1. By accessing and/or using the website, you accept these terms and agree to be bound by them, and an agreement is formed between us and you.
2. These Terms may be amended at any time without notice and your access to this website may be terminated at any time without notice. Your continued use of the website following such amendment of these Terms will represent an agreement by you to be bound by these Terms as amended. We recommend you review the terms for amendments each time you use the website and before placing any Order. Should we choose to provide you with notice of amended terms, you agree to receive email notification of the amendments from us or our third party.
3. Your receipt of goods purchased requires you to provide your name and address, telephone number and a valid email address except under special circumstances which Exotic Planet may require in writing. If you do not provide accurate and complete details we cannot guarantee delivery of products purchased to you.
Legal Capacity
1. You must be eighteen (18) years of age or over to purchase products from Exotic Planet.
2. Any Order and/or purchase made by you using this website is an acknowledgement by you that you:
i. are over the age of eighteen (18) years;
ii. accept these terms;
iii. agree that you have entered into a legal contract with Exotic Planet online in relation to these terms; and
iv. these terms, together with your order, constitute the entire agreement between you and Exotic Planet for the supply of products.
v. Exotic Planet reserves the right to take legal action and seek compensation from the parent or guardian of a minor who causes an order to be placed, for any loss or damage Exotic Planet may suffer as a result of a transaction entered into by a minor.
Orders
1. Please choose carefully as refunds are not normally provided
2. Orders will not be considered finalised until Exotic Planet has received payment in full including costs related to shipping and handling.
3. Orders will be limited to items listed on the purchase invoice, please review your invoice / order carefully prior to finalising payment.
4. You must acknowledge that:
i. the transmission of your offer or the confirmation of any payment, made through an electronic instruction may not be received by Exotic Planet for reasons beyond either parties' reasonable control including but not limited to, electronic failure, mechanical, software, computer, or telecommunications, or the omission or failure of third party website providers or systems;
ii. to the extent permitted by law, Exotic Planet is not liable to you in any way for any loss or damage at all and however caused, arising directly or indirectly in connection with the transmission of an electronic instruction through our website, or any failure to receive an electronic instruction for whatever reason;
iii. Exotic Planet may act on and process all completed electronic instructions transmitted or issued through our website without further consent from or reference to you; and
iv. Exotic Planet may treat an electronic instruction as authentic and is under no obligation to investigate the authenticity or authority of persons issuing or transmitting such electronic instructions, or to verify the accuracy and completeness of such electronic instructions.
v. We reserve the right to refuse or cancel any orders, whether or not the order has been confirmed and your credit card charged. If your credit card or account has already been charged for the purchase and your order is cancelled, we will immediately issue a full credit to that credit card or account.
vi. In the case of a live animal order, where you have paid for the purchase and your order has been cancelled, your card or account will be credited the full amount, minus the deposit. We will inform you as soon as possible of any changes in prices, or cancellation of orders.
Price and Product Information
1. Prices shown are in Australian dollars and include GST where applicable. Prices may not include delivery and handling charges. Prices are subject to change without prior notice. If we have made an error in pricing, we will notify you of the correct price and give you the option to cancel.
2. All information displayed on our site is believed to be accurate and reliable at the time of publishing. Errors such as misprints and/or omissions are excepted. We reserve the right to make changes and corrections at any time to prices, products, and specifications without prior notice.
Payment
All payments including costs related to shipping and handling must be made in full prior to delivery.
Supply
1. Products may not be available for immediate delivery. Exotic Planet will endeavour to deliver your Order to you as soon as possible after your order is finalised.
2. The delivery address must be an address within Australia and cannot be a freight forwarding location. Deliveries cannot be made to PO Boxes.
3. You will be required to be available in person to accept delivery of your Order.
4. Exotic Planet will use its best endeavours to deliver your Order within any stated timeframes for dispatch, however we do not warrant that these timeframes will always be met, as many factors may affect these timeframes.
5. You must advise Exotic Planet at the time you place your order of any difficulties that may be involved in the delivery (such as stairs or narrow entries). If you do not state the situation correctly and on arrival the delivery contractor deems it to be a difficult location you will be liable for any extra charges including redelivery fees and the cost of an extra person to assist.
6. Exotic Planet cannot and will not accept responsibility for delivery failures or delays by our third party delivery contractor.
7. Unless Exotic Planet are notified to the contrary on the day of delivery (and, in any case, written confirmation is received within two days) the Products shall be deemed to have been accepted by you as being in good condition and in accordance with the order.
Warranties and Liability
1. We warrant all Products which have been manufactured by us against defects in design, materials and workmanship. Exotic Planets obligation under this warranty shall be, at our option, to repair any manufacturing or component defect at our premises or to replace free of charge or refund the cost of any Products (or Product parts) which are shown to our satisfaction to have been defective under normal and proper use in accordance with any stated or published specification. Notice of all defects (together with satisfactory proof of the defect) must be given to us immediately after discovery. We will only be liable for claims received within one year of the date of delivery. You shall return all defective Products to us at your own expense if required to do so by us.
2. Exotic Planets liability in respect of any goods not manufactured by us, but supplied by us shall be to give you the benefit of any manufacturer's guarantee or other rights (if any) which are available to us against the manufacturer or its own supplier of such goods or materials.
3. Exotic Planet shall be entitled to require you by notice in writing to cease immediately the operation of any of the Products in respect of which any defect has been notified to us and if you fail to comply with this requirement we shall be under no liability to you either under the warranty in this section or otherwise in relation to the Products. Where for any reason no such notice has been given to Exotic Planet we shall not be liable for any damages or losses whatsoever suffered by you to the extent that it is caused by the continued operation of the Products after a defect became apparent.
4. Exotic Planets liability under this section shall be limited to the value of the Products supplied under the order to which any claim relates or the amount received by us in relation to the Products under any product liability insurance currently held by us (whichever is the greater).
5. Exotic Planet will have no liability for any indirect or consequential losses or expenses suffered, including (but not limited to) loss of anticipated profits, goodwill, business contracts or losses resulting from third party claims.
The Exotic Planet French Bulldog Guarantee
1. Once a Puppy has been selected and decision to purchase has been made, the total price of the item will be collected, where $1000 of the total will be considered a deposit. Shipping Costs will be arranged and paid for separately for up-to-date quotes and timing.
2. The puppy will remain on the market until the deposit or full funds have been cleared into the Exotic Planet bank account. Deposits are NON-REFUNDABLE.
3. The puppy will remain in the care of Exotic Planet until the puppy is ready to be shipped to the purchaser. All Puppies come vet checked, wormed, immunised, micro-chipped and registered with Dogs NSW. Exotic Planet reserves the right to choose which dogs will be on Limited or Main Registration.
4. The puppy must be paid for in full, including shipping fees, by the time the puppy is 7 weeks old. Shipping fees vary from state to state and include airfare, crate, and health certificate. Puppies will not be shipped before they are 8 weeks old. Exotic Planet guarantees that the puppy is healthy on delivery. Puppies not received or paid in full by 9 weeks of age may be retained by Exotic Planet and deposits may be forfeited.
5. Late Delivery in special circumstances is always discouraged but may be considered and is always at the discretion of Exotic Planet. A caretaker’s fee will be charged in this instance and must be paid in full along with all monies owing prior to delivery.
6. Exotic Planet requires the purchaser to take the puppy to a veterinarian for a complete physical examination within 48 hours of receiving the puppy. If the purchaser does not take the puppy to a veterinarian within 48 hours, this guarantee and all warranties are void. Exotic Planet must be notified of the results of the examination immediately following the examination. If the veterinarian finds the dog to be in poor health or detects any physical problems that would require further veterinary care, the purchaser must notify Exotic Planet immediately following the examination. A report of the results from the veterinarian must be forwarded to Exotic Planet within 24 hours of production. Exotic Planet will contact the purchaser’s veterinarian for verification.
7. The puppy will be guaranteed for twelve months after delivery against any life threatening defects. If the puppy is found to have a life-threatening defect, a complete report from the purchaser’s veterinarian must be forwarded to Exotic Planet within 48 hours after the determination. If the puppy dies within this 12-month period, the purchaser will pay for a necropsy to ascertain the reason for death. If the reason is congenital, Exotic Planet will replace the puppy with one of the same value, to be determined by Exotic Planet. A replacement puppy will be arranged but may not be available immediately. The purchaser will wait until a puppy from a future litter is available. The purchaser is responsible for all shipping expenses on a replacement puppy. Exotic Planet does not cover any veterinarian bills. The health guarantee is not valid if the puppy has been sold or transferred to a new owner.
8. The health guarantee does not cover the following: Treatment for internal or external parasites or bacteria, cherry eye, loose hips, loose knees, skin allergies, elongated soft palate, and small or collapsed nostrils, bad or uneven bites, undescended testicles, Demodex, mange, inguinal or umbilical hernias, fleas, ticks, ear mites, coccidia, kennel cough, Giardia, thyroid dysfunction.
9. There is no money back if the purchaser decides the puppy isn't to their liking. Exotic Planet also retains 1 breeding right on all males sold on main registration, (any costs incurred will be paid by exotic Planet).
